Terms and Conditions
- Fees
- 1.1 Whilst we will try and accommodate all booking requests on courses and expeditions, places are limited and we cannot guarantee a place on any course or expedition. All bookings are provisional until the Fee is paid in full and confirmed by us.
- 1.2 We reserve the right to refuse any booking request without explanation to you.1.3 VAT will be charged in addition to the Fee if it is applicable. The Fee includes only those items expressly included by reference to the course or expedition brochure.
- 1.4 We will only provisionally reserve your place when we receive a completed booking form and the Deposit from you. The Deposit is not refundable once a place has been confirmed unless the course or expedition is cancelled by us.
- 1.5 The balance of the Fee is payable by the Due Date. If you do not do this then we may treat your booking as cancelled by you after the Due Date.1.6 If you wish to reserve a place for any booking after the Due Date you must complete the booking form and forward it to us with payment in full of the Fee, but this is always subject to Clauses 1.1 and 1.2.
2. Cancellation by you:
2.1 All cancellations must be in writing by recorded delivery post, fax or email. Cancellation takes effect from the date we receive your letter or fax.
2.2 In the event that the course or expedition place is resold prior to the commencement of the expedition, you will receive a full refund less the amount of the Deposit to cover administration costs.
2.3 Refunds will only be made after the course or expedition has commenced.
2.4 In the event that the place is not resold prior to the commencement of the course or expedition, you will be charged the following cancellation fees:-

2.6 All course or expedition bookings are transferable provided: (a) at least 2 weeks notice is given by the transferor to us; (b) the transferee satisfies the requirements of the course or expedition; (c) the transferor and transferee agree to be jointly and severally liable for the total course or expedition fee; (d) payment of an administrative fee equal to 10% of the Fee.
3. Cancellation by us:
3.1 Whilst every attempt is made to ensure that advertised courses or expeditions actually run, it is in the nature of our courses or expeditions that occasionally the courses or expedition may have to be cancelled or a major change in the destination of the course or expedition may have to be considered. We will notify you of the cancellation or any major change of destination as soon as is reasonably practicable.
3.2 In the event of cancellation you will be offered the choice of the following options:
3.2.1 Full refund of the Fee paid and compensation according to the table at Clause 3.4.
3.2.2 Another course or expedition provided by us on different dates and compensation according to the table at Clause 3.4.
3.3 In the event of a major change in the destination of the course or expedition you will be offered the choice of the following options:

3.3.1 Accept the change and receive compensation according to the table at Clause 3.4.
3.3.2 Cancel your place on the course or expedition and receive a full refund of the Fee paid and compensation according to the table at Clause 3.4.
3.4 The compensation payable by us is shown in the table below. However, in no case will we pay compensation if the cancellation or major change in destination is due to events listed at Clause 3.5

3.5 Important Note
Compensation arrangements do not apply to circumstances beyond our control. We can cancel the course or expedition in the following circumstances: war, threat of war, riots, civil strike or terrorist activity, industrial disputes, natural or nuclear disasters, fire, technical problems with transport, airport closures, bad weather conditions, the number of filled places not reaching the stated or workable minimum and similar events beyond our control.
4. Minor Changes to Expedition Itineraries:
4.1 It is in the nature of our courses or expeditions that the itinerary of any course or expedition is a provisional itinerary only and may be liable to revision due to circumstances, in particular weather conditions, beyond our control.
5. Our Liability to you:
5.1 If you, or any member of your party, suffers injury or damage to property by our failure to perform, or our improper performance of, our agreement with you for the provision of your holiday we accept liability except in the following circumstances:-
5.1.I. If the failure or improper performance is your fault or the fault of any member of your party.
5.1.2. If the failure is the fault of someone else not connected with the provision of the services that make up the course or expedition which we have confirmed to you.
5.1.3. Any unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised.
5.1.4. Any event which we, or the supplier of any service, even with all due care could not foresee or forestall.
5.2 The only limitations on our acceptance of liability set out above are that:-
5.2.1 except in cases of personal injury, our liability will not be more than twice the value of the Fee.
6. Your obligations:
6.1 You are responsible for ensuring that the following matters are in place before the start of the course or expedition and remain valid, enforceable and effective for the duration of the course or expedition:
6.1.1 For RYA Sea Survival or practical sailing or kayaking courses, you must be a competent swimmer and confident in the water.
6.1.2 You must be physically fit to take part in the course or expedition and not suffer from any medical condition that would prevent you from taking part in any activities. If in doubt you must obtain your doctors advice.
6.1.3. Travel and medical insurance.
6.1.4. Supply of own equipment as specified in the course or expedition brochure.
6.1.5 Flights (if necessary).
6.1.6 Visa (if necessary).
6.1.7 Vaccinations (if necessary).
6.2 We may ask you to provide proof that you have complied with the requirements of Clause 6.1. Regardless of this, we cannot accept any liability whatsoever for any failure by you to have made the arrangement as set out in Clause 6.1.
6.3. If you are unable to participate in the course or expedition due to a failure to make the arrangements set out in Clause 6.1 we are entitled to treat the booking as cancelled by you on the start or departure date.
7. Safety Regulations:
7.1. Safety is of paramount importance on all our courses and expeditions. For this reason your course or expedition leaders will from time to time set regulations for the safety of all course or expedition members. Any course or expedition member failing to adhere to the decision of the leader on safety matters does so at his or her own risk.
8. Disagreements:
8.1 If you disagree with any decision of ours taken under this Agreement please contact us immediately and we will discuss the same with you. However our decision, and interpretation of events, is final.
